Former San Bernardino County Supervisor Paul Biane filed separate claims against both the county and State of California on Friday.

Both claims, filed by Woodland Hills-based Attorney Dale Galipo, allege multiple causes of actions resulting from the Colonies prosecution debacle, where Biane, Mark Kirk, former chief of staff to Supervisor Gary Ovitt and Developer Jeff Burum were acquitted of all charges related to a 2006 settlement of $102 million over a flood control land dispute.

Former Assistant Assessor Jim Erwin, whose separate jury resulted in a mistrial, had all charges dismissed.

The primary focus of each of the claims targets the fabrication of evidence used at trial and before a 2011 indicting grand jury.

Biane’s claim is the fifth to be filed since the failed prosecution ended. In all, the cumulative total of damages claimed could surpass $200 million, with Burum impacted the greatest from a financial standpoint.
