Congressman Kevin McCarthy (R-Bakersfield) the front-rummer to replace outgoing Speak of the House of Representatives John Boehner (R-Ohio) has withdrawn his name from consideration.

McCarthy had been struggling to amass the necessary 218 republican votes necessary to assume the top spot in the House.

The news comes as an unexpected surprise.

Prosecutors who intentionally withhold evidence from defense attorneys or the court could face tougher punishment and greater scrutiny under a new state law prompted by the misuse of jailhouse informants by Orange County prosecutors.
