RIVERSIDE >> A Superior Court judge has issued a tentative decision in favor of Los Angeles on two key aspects of lawsuit for control of L.A./Ontario International Airport.
Los Angeles filed a motion in September trying to remove portions of the suit, arguing that the statutes of limitation of rescission and reformation is three years, and Ontario’s claims are more than 40 years late. Attorneys for L.A., in documents filed with the court, argued it was a sale.
Judge Gloria Connor Trask wrote in her decision: “The court upholds that the 1967 Joint Powers Agreement complied with applicable statues and was lawful.”
In addition, Trask found that Ontario had the power to transfer Ontario Airport but if it wanted to void the agreement, it had to do it within the 4-year statue limitation.
