No charges have been filed against a sheriff’s deputy who allegedly had sex with a 16-year-old female Explorer, officials said Monday.

Because Nathan Gastineau of Redlands was released from jail on bail, he does not have to be charged and arraigned right away, said district attorney’s spokeswoman Susan Mickey.

“There’s a clock running on people in custody and that’s 48 hours,” she said. “We have to file charges (within 48 hours) or they’re released.”

Mickey would not speculate on when or if the District Attorney’s Office would file charges against Gastineau.

Gastineau, 30, is a 10-year veteran and led the Highland Police Explorers, a program offering law-enforcement training to students from 14 1/2 to 21 years old.

He was arrested Friday on suspicion of committing lewd acts with a minor after the Sheriff’s Department received information he may have had a sexual relationship with a 16-year-old girl from the Explorer program.

He was booked into West Valley Detention Center in Rancho Cucamonga. He posted $25,000 bail over the weekend.

The Sheriff’s Department placed Gastineau on administrative leave as it investigates the case.
