The criminal conspiracy case involving the 2006 settlement, between Colonies Partners L.P. and San Bernardino County, has landed on the radar of the California Supreme Court.

In orders filed Wednesday, the court granted a defense request for judicial notice of the 2007 Judgement of Validation for the $102 million settlement.

In addition, the Justice’s also limited the issues to be argued and decided to a single question. The question being; “Can a bribe offerer be charged with conspiracy to committ bribery, and aiding and abetting the receipt of a bribe, where his conduct satisfies the elements of both crimes?”

The court will not address conflict of interest charges, previously dismissed by the Court of Appeal.

The case is now pending placement on the court’s oral argument calendar.
