Three agencies being sued by San Bernardino County in connection with a controversial $102 million settlement are asking a judge to dismiss the lawsuit, claiming they should not be held responsible for an alleged corrupt agreement.

The flood control easements imposed on the developer’s property did reduce the value of their property. It is just that simple.

Good luck getting those brainwashed by the local media to understand that simple concept.
Here’s another “simple” concept they resist: The county tried to expand the scope of those easements to force the developer to install flood control improvements that should have been the county’s responsibility. The developer fought back, and won.
SANBAG and their loser attorney attempting to use Bill Postmus as there evidence because Postmus plead guilty, then told the FBI that None of it happened! Good luck with that one.
Observer… The city I live Upland continues to spend-away millions (last time I checked the total was near 6 million) in legal fees. My sources tell me that Upland and/or San Antonio Water Company providing misleading data which resulted in expanding “the scope” and forcing the developer to install flood control improvements. Upland’s former Councilman Ken Willis remains defiant and has dodged testifying for years.

I agree; it’s difficult to imagine a less credible witness than Bill Postmus.
In addition to telling the FBI he wasn’t bribed, he has admitted being under the influence of meth dozens of times, and one of the judges has already stated on the record that he has a credibility issue.
Bill Postmus is also Mike Ramos key witness for the prosecution of “the most appalling corruption case in decades, certainly in the history of San Bernardino County and maybe California itself.”
If that case ever goes to trial, the cross examination of Mr. Postmus should be very entertaining.

As I have stated before, the problem is that elected officials get to gamble with taxpayer money, and have no downside. If they win, political grandstanding ensues. If they lose, taxpayers pick up the tab.
If Ken Willis or Jon Mikels had any of their own money at risk, I suspect that this entire matter would have followed a different script.
#6 – Willis prides himself as the “water expert” of Upland. The old boy Willis, Thomas, Musser and the now felon former mayor Pomierski lined their pockets as they sold Upland down the river. No controls whatsoever. They should all face the music in court for placing Upland at risk.
I am sure this weakens the DA case against the defendants! What a waste of taxpayer money.
