The battle to represent the 31st Congressional District continues to heat up.
State Senator Bob Dutton (R-Rancho Cucamonga) has given terse response to a hit piece sent out by the campaign of Congressman Gary Miller (R-Rancho Cucamonga).
In the email, titled “In the Gutter with Gary Miller”, Dutton actually recites a line from Barack Obama’s playbook.
We had hoped the day would not come when my opponent decided he needed to crawl into the gutter and pull out his bag of dirty campaign tricks. He decided that instead of talking about his own record he would resort to the old practice of career politicians, “If you don’t have a record to run on, then you paint your opponent as someone people should run from.” I have pledged to run this campaign on my record as a local Councilmember, a State Assembly Member and State Senator.
The response comes on the heels of Miller sending out a mailer with a photo of Dutton sleeping during a floor session and criticizing him for voting on several unbalanced budgets.
Voters lose respect when this type of negative campaigning happens. So sad Miller has lowered his tactics to this level. Yes, you are changing votes Mr. Miller, but not in your favor…..
So Dutton decided it was okay to plagiarize the President. Wow! Bad move. Maybe he thought no one would notice. He must be getting desperate.

Maybe Dutton needs staff who knows the rules of writing. If he was a journalist he would have been fired. Maybe he should fire the staff that allowed the email to go out.
I am going to stop the back and forth now. Bottom line, if a high school English student has to understand the rules of plagiarism and when to quote someone, a candidate for US Congress should too.
Dutton has been going negative on Miller since the primaries. It’s only dirty politics when you can’t take it, but not when you dish it out. Time to call Dutton out on his big spending record while in the CA Legistature, which was the subject of Miller’s mailers. Read it for yourself.

Wow, that sos link shows that Dutton filed for the 2018 Supervisor committee in June of this year. Seems odd to form a committee just weeks after the primary unless you think you are going to lose.
Let me point out that although Dutton hasn’t released any negative lit for Congressman Miller he has frequently took shots at Gary in press interviews and has personally attacked Gary at numerous occasions at candidate forums. Why isn’t Bob defending his record instead of bashing Gary.

3. When Gary talks about representing this area he mentions Chino, Ontario etc. none of which are in the 31st.

Ok, so much fact checking to do here, I don’t even know where to start.
First of, plagerism, Dutton did not claim the line as his own. If you read the whole letter it’s obvious that he’s not trying to plagerise anything. He’s using a term that’s been used a lot this election cycle in the Presidential race. Trying to say he “plagiarized” it is an obvious attempt to distract people from the main point. It’s petty.
Second, negativity. Dutton has not “taken shots” at Miller. He’s pointed out that Miller does not live in the district. So what? Is that really what passes as “negative campaigning” these days? Contrary to what Miller’s campaign staffers would have you believe, Miller has no roots in the district. he has no family here, he has never represented a single constituent here. Duttons imply pointed that out. Dutton is the home town hero who has lived here for 40 years and represented the area in Sacramento for 10. It’s a contrast to Miller. It’s not dirty.
Fact of the matter is, it’s public record that Miller took his latest DC contribution and did a poll. He didn’t release the poll results but then sent out 2 hit pieces on Dutton stating “he went there first so I’m following.” Bull crap! Logic dictates otherwise. It doesn’t take a political rocket scientsit to see that Gary was trailing far behind in the polls so looked for an excuse to go negative to even the odds. More evidence, campaigning 101 is if you’re ahead in the polls you don’t go negative, because it can backfire.
Third, the Ramos endorsement. This has been talked about in this blog and many others many times so I’m not sure why it’s still an issue. Neil Derry commited felonies and abused the public trust. Felony charges were brought against them, and he was able to plead them down to misdeameanors (a good move on his part because felons can’t hold public office). People always say they want politicians who aren’t strict partisans and don’t support members of their own party simply because they have the same letter next to their name. it was GOOD judgement not to support somoene who abuses the public trust by committing felonies. Fact check the fact checking if you want, google Neil Derry and see for yourself.
Dutton was also not the only GOP to endorse Ramos. The Derry and Miller camp try to spin this by saying that only politcians who hope to gain endorsements from the Indians endorsed him. Well, no, that’s just not true. Just one example, Jerry Lewis endorsed Ramos. Jerry Lewis is retiring, he has nothing to gain financially from doing so. And if you’re mad about GOP not supporting GOP, let’s not forget Derry got elected by challenging and running a smear campaign against a sitting GOP supervisor. Plain and simple, the Ramos endorsement is a non-issue. Fact of the matter is Derry is in trouble and Dutton has little he can be attacked on, so the Derrya nd Miller camps are using this as straws to grasp at in order to give the appearance of impropriety. Do just five minutes of homework and you can see through the BS with ease.
I think the last thing I need to address is the Supervisor account. I’ll admit the first time I heard this I raised an eyebrow, but in the last debate Dutton cleared it up. There are strict laws regarding what he can and can not do with the money he’s raised, so he opened the account to help consolidate and close his previous accounts. he can’t legally use it for the Congressional bid, but it’s got to go somewhere. Again, a non-issue, it’s been explained, and Miller’s staff trying to repeatedly bring it up is them again grasping at straws, trying to find a way to go negative.

You claim that “Neil Derry committed felonies.” In fact, the felony charges were unproven allegations that the Attorney General agreed to dismiss.
You claim that Neil Derry “abused the public trust.” That sounds like opinion rather than fact.
Here’s my opinion: Mike Ramos fabricated bogus felony charges against Neil Derry to help James Ramos attempt to unseat him. Mike Ramos himself committed a far more egregious violation of FPPC rules, and was only fined.
Mike Ramos was clearly out to get Neil Derry, and all he could come up with was the alleged laundering of a single $5,000 campaign contribution that was fully reported. If that’s all he could find, there was not much to be found.

Fact Checker, if it is due to campaign finance laws why does he still have an Assembly account, Senate account and a Supervisor account? Seems like he could just have one. Also, why did he form this 2018 account in June? He already had a 2014 account. Why was we worrying about opening a 2018 account just a few weeks after the primary and receiving donations in his accounts while running for Congress? No one gives money to a candidate if he will never spend it. Seems like he is trying to position himself for another office. One account, maybe just to have a state account. But 4 (with the federal) and still receiving donations in his state accounts? The voters will see him as he is… a politician looking for the next seat.

Derry- No, sorry, you are incorrect. The felony charges were not “dismissed.” They were plead down. That’s why Neil Derry could not vote on many county issues. Do a google search yourself and see. I don’t have time right now to grab the relevant articles but there are so many that it shouldn’t be hard for you to find. And I think they’ve been posted on previous posts in this blog too so do your homework and see for yourself.
Also the charge that Ramos fabricated charges are laughable, because these charges come from 3 years ago, long before Ramos was in the race, and if he was truly innocent he would not have plead them out. Carpetbagging- Where a candidate lives is a genuine issue. You can call it petty, but I think it’s up for the voters to decide if it’s relevant or not, don’t you? Had he not agreed with the deal that Judge Dest negotiated with the AG, James Ramos could be talking about the “felony charges” hanging over his head. Either way, Mike Ramos would have achieved his objective.

Pleading charges down from felonies to misdemeanors IS pleading guilty. When you plead down, you plead guilty to a lesser offense. Any elected official who would plead guilty in court clearly did something wrong. When you’re elected, your integrity is your most important asset, so why tarnish it unnecessarily by pleading guilty to something you didn’t do. Again, LOGIC.

By the way, in a Republican district, as the incumbent, Derry only got 33% of the vote. Ramos got nearly 50% and another candidate who ran a virtually nonexistent campaign took 20% simply because he was a Republican that wasn’t Derry. Case closed.
