UPLAND — Councilman and mayoral candidate Gino Filippi has been accused of violating the city’s ethics code ordinance. Filippi suggested and voted for the ordinance, but now questions its legality.
Tom Mitchell, chairman of the City Council Advisory Committee, publicly accused Filippi of the violation during Monday’s council meeting.
“I believe during the July 23 council meeting Mr. Filippi broke the law. He put the city of Upland in a precarious position,” said Mitchell, the longtime campaign manager for Mayor Ray Musser, who is running for re-election in the November election.
According to the city’s Code of Ethics and Conduct, any elected official receiving more than $1,000 in campaign donations from any person, firm, corporation or associated/related group with ties to an issue up for vote by the council, must abstain from voting on the issue for one year following the date of the donation.
Filippi accepted $2,000 from the Upland Firefighters Association in May, according to his contribution forms.
He voted in favor of the association’s new employment contract in July.
“Retrospectively we (his campaign) should not have accepted the contribution in May, but rather after all items were completed with the council,” Filippi said. “We are returning the contribution and awaiting opinion from the City Attorney whether the city’s new campaign Ordinances are legal.”
The city has asked interim City Attorney Jimmy Gutierrez to look into Mitchell’s accusation and Filippi’s questioning of the ordinance’s legality.
Upland Firefighters Association President Michael Carney confirmed that Filippi has agreed to return the donation.

How about for the past 4 election cycles(that’s every two years for those that dont know) Musser has taken $500 to 1,000 per election from Burtec Waste. He has never recused himself from a vote on the city sanitaion contract. Under Mitchell’s law, Musser would be in violation of his own ordenance.
Musser was in debt for the tune of 70K after the last election he lost. He does not want anyone to raise money because he can’t. He made the ordenance so that the “playing field will be even”. It passed because of the fall out from the JP debacle and overwhealming pressure for the council to appear that they had done something to prevent this kind of thing in the future. Former City Attorney Bill Curley warned Tom Mitchell that the ordinace was very shakey and if the inference of the ordinance was to level the playing field then it would never stand up in court if challenged. You can not restrict an individuals or organizations right to contribute money to any campaign or candidate at any level. It goes to an argument of Free Speech. The Ethics Code, is not Ethical.

He’s a life long resident, a numbers guy, that understands without cuts the city goes BK. He has made hard, unpopular cuts that will benefit Upland for years. If you live in Upland, support him, if you are just on the bloated payroll then hate on.

@anonmya**- how come you don’t shed any of the blame on the Treasurer, Dan Morgan. He is supposed to be the vanguard of the city coffers. City manager is at least a qualified finance director. How exactly do HIS numbers not add up? I seem to remember he was the first to expose the budget problems after Quincy left. How is he now the villan? This may come as a surprise, some of us actually make comments that are based upon factual knowledge and not just gossip. Dunn is a married man and reckless comments only hurt outside family members.
Dunn has made substantial cuts, while maintaining essential services. He virtually wiped out a layer of needless fire department management (that comment will get a response!).
Upland is a small town with a limited tax base. If it wasn’t for the colonies they Could have easily been the first city in bankruptcy court. Dunn is making unpopular decisions that will benefit residents (which I doubt you are) for years to come.

Pay and benefits at about $200,000 a year. And I created this position all during the time I was cutting other positions! Cut this “Assistant to the Executive assistant” position and you save $200,000. But that won’t happen because I only made this position specifically for my girlfriend. And before you say this is a needed position, Upland had a City Manager and and Assistant City Manager with only one assistant. Now why does just one City Manager now need to assistants? He doesn’t! Thanks. I truly hope you are not to disappointed when you realize this is the truth. It is known throughout City Hall and there is other proof that I am not willing to state over this blog. I am personally not after Dunn, I just believe it is time people in Upland government are held accountable!! It is time for new leadership!!!! When Quincey was terminated, the same underlings that he was in charge of was placed in charge. It was a very bad decision. None of the needed change in Upland government, just different names!! I am tired of executive management of Upland covering up for bad employees and tired of executive management thinking they can do whatever they want with no consequences. Part of Leadership is “lead by example”. The executive management of Upland (not all, just certain ones and they know who they are) have been very poorly leading by example and certain employees are following that example with no punitive consequences for their vile actions. How can you enforce the rules when everyone knows you are breaking the rules yourself?

When you first started accusing Dunn of his indiscretions, I had to look into it for myself. I couldn’t believe Dunn could be that stupid and bold. All I can say is, Wow! I guess true stupidity runs rampant at the top. Why is it when certain people are placed in-charge they lose all brain functions that they had moving up the ladder? I checked into it myself and found out everything you have been saying is true. It blew me away. I couldn’t belive Dunn was so bold as to make a position just for his girlfriend, all the while cutting police positions saying we have no money!!
And here is what I also found out that you either don’t know, or you haven’t told yet. Mayor Barney Musser has known about this indiscretion by Dunn for a couple years, even before the new assistant to the city manager position was created by Dunn for his girlfriend!! In my book, Mayor Barney new about this extreme favortism of Dunn creating an unnecessary position at the whim, and benefit, of the City Manager all the while Dunn cutting needed positions for the City’s safety. And Mayor Barney allowed it to happen.

Here is a quote from Councilwoman Stone’s recent interview about cutting Council pay:

Well Ms. Stone, leading by example does not pertain just to Council pay! Leading by example should be an intricate part of everything you do, especially when it comes to your position as a Councilwoman for the City of Upland. INTEGRITY!!!!
To ALL Councilmembers, it is time to step up and start leading by example for the people of Upland!!! Do what is required by Upland policies and the Upland Municipal Code. Investigate your City Managers inappropriate relationship with his direct subordinate. Investigate the damage it has caused to the City of Upland, such as a personally initiated (by the City Manager) fulltime, full benefit position that was given to his girlfriend with no Merit requirements as stated in the Upland Municipal Code. Also investigate the costs of this uneeded and unecessary position (which I saw on a local blog at about $200,000 per year in pay and benefits) and the cutting of other, all ready established and needed positions, due to the recommendations of the City Manager himself.
How can the City Manager recommend cutting positions important and needed one day, and creates an uneeded and unecessary position that he personally benefits himself the next day?

Okay, I had a talk with my guy, who knows another guy. I wouldn’t take an oath on this but I would bet a cup of coffee.
1- His assistant earns under $70,000, not the $200,000 mentioned.
2- The position was posted and any one could apply, an independent panel stated she was qualified. (she has a masters degree)
3- While Quincy had only one executive assistant, he also had an assistant City Manager at nearly $300,000 . No net gain in assistants, financially, you can do the arithmetic .
4-Under Dunn the city has made close to $5,000,000 in spending cuts. It is reasonable to think all offices have been realigned. She wasn’t added to city , she was transferred from another department.
5- Due to “anonymous” emails (I wonder where they came from) the city had the current city attorney investigate these claims, without issue.
6- Both parties deny a relationship beyond good friends. Annette is married with four kids
Certainly having a boyfriend or spouse both working for Upland is not unusual. I don’t see this as an issue either. In conclusion, I don’t see any reason to my opinion of Dunn. Of course my opinion and two bucks can get you a cup of coffee.

I will confirm all that you have listed. I dont believe there is any merit to the accusations either. I was aware of the accustation before he beacme CM. He also didnt seek the job but was persuaded to take over as he had the only working knowledge of the cities finances and operational requirements after Quincy was fired. These people always start this kind of muckracking during an election cycle. Just like when the city was going to be sued for having the tiller truck in the Colonies. Now that the old Fire Chief is gone, they are done threatining. I like to call it a witch hunt.

1. The position with pay and benefits (not just pay) between $150,00 and $200,000. You as a business owner know that employee costs are not just limited to pay. Pay and benefits (cafeteria, retirement etc…). So quit trying justify!!!
2. The position did not follow the “merit process’ in accordance with the Upland Municipal Code. The one and only, current, Assistant to the Executive assistant was chosen by Dunn using no list.
3. The Assistant City Manager was a position that was abolished due to no need for the position and monetary constraints. The Assistant CM position was not downgraded, it was abolished. If it was a truly needed position it would have been downgraded, it was not, it was abolished!! Milheiser had only one Executive Assistant and Quincey had only one Executive Assistant for two years. Assistant to the Executive assistant an uneeded and unecessary position. As proven in the recent past (Quincey) and the longer past (Milheiser). So once again, quit trying to make it look good, when in fact it is what it is!!!
4. I can not argue with the cuts, but she was promoted into her position. Her position with the City Managers office was added! And her position in public works still exists. So my count is +1 not -even-as you would want people to assume. So yes a new position was created just for her.
5. Wrong! No investigation has occurred. I believe that is all the “anonymous” e-mails is calling for, is an investigation into this mess. And if the City Attorney does the investigation that is just another conflict of interest by the City of Upland. A City Attorney can not investigate, that is not their job. City Attorney advises on legal issues not investigates misconduct!

AnonmyA, I guess you missed my request for at least one fact. Benefits are not 80,000 to 130,000 for a $70,000 job. Not even a public job! You are simply wrong on your other assertions.

As every election cycle has passed, it has become a common theme for Ray Musser to claim publicly the wonderful job he does and how great a Christian man of faith he is, but the real crux of his campaign has always been derived from his surrogates and campaign workers consistently using all negative smear tactics to berate any and all candidates that are not part of their team.
Ray has never publicly made any of the negative things you hear during a campaign his personal crusade, but uses others to launch accusations and malicious disinformation to further his support. He has no real legs to stand on in a political race so he can only win by going negative. Twisting and exaggerating a situation to look like an “I gottcha” moment is all Ray Musser has ever had to campaign with.
The recent use of the brand new and just adopted “Code of Ethics” has not only been exaggerated for political gain but has also been shown for what it is. This was an attempt for Tom Mitchell to level the playing field in the coming elections so that his candidate would not be so outspent that he would never stand a chance in an open mayoral campaign. The arbitrary $1,000 contribution limit, while somewhat well intentioned as to keeping $20,000 donations from buying a liquor license from the council and planning commission, is and cannot be a limiting factor just because someone can raise more money than you.
The exact clause that the Musser campaign accuses Councilman Gino Filippi of violating is the one that Tom Mitchell personally wrote and added to the ordinance after the first reading. At the time this was being vetted in committee, the exact use of this ordinance was discussed. It was the majority feeling that this kind of a contribution limit was meant to help regulate the escalating campaign contributions and influence of the previous mayoral races. It was only agreed upon under the flat denial that Tom Mitchell had written this for the purpose of being the regulator in the next election and using it for political gain. It turns out this was the case.
At the time, the city attorney warned that this ordinance, if challenged, would not stand up to legal scrutiny. This ordinance was constructed and written as a self-enforcable ethics code and was purely voluntary.
Spreading the implication that laws were broken and criminals exposed is a misuse of the spirit of the ordinance and is an opportunistic political ploy. As we have seen in the past, Ray is not in control of his own campaign and has allowed the use of his office and his campaign to continue a personal attack on Councilman Filippi by whatever means necessary, instead of focusing on fixing the budget and keeping our city safe.
Ray, you have forever lost my respect, my trust, and my vote.

Which I thank my lucky stars everyday. The mood of most employees that actually work in city hall is about as low as I have ever seen. And there is only one reason, CM Dunn. Everyone in the city knows (except for Rancho business owner and INsider) what is going on with Dunn and Annette. It’s been going on for a long time, well before she became to the CM’s office. And Musser (which always claims he is a good Christian man) has known the entire time. Since when is Adultery part of the Christian morals? Anyways, back on subject.
I agree with AnonMyA, this is a major concern for the citizens of Upland. What a conflict of interest. Everyone likes saying, “run Upland as a business”. Well a business of Upland’s size would not allow two people as involved with each other as these two are, to be 2 of the 3 people in the highest office of the corporation!!
If anyone was to go and spill the beans about this matter, the retaliation would be so severe and swift your head would be spinning. That has already happened with at least one employee that witnessed the two in a very comprimising place.
The current executive staff (not all) of Upland are the worse I have had to work for in my multiple years. They rule by fear and intimidation! The saying that best describes them, which has already been said: “Do as I say, not as I do!!!”

If you have met Annette she is bright, intelegent, and effective. She as a masters degree and is more competent than than several others I could but won’t name. She is Dunn’s assistant, not The assistant to his assistant . She is more than qualified , and was found to be so by an independent panel.

The Assistant City Manager position was not eliminated by Dunn. It was eliminated when Foster left for Colton. So Quincey actually eliminated that position and had only an Executive Assistant after Foster left. Dunn had nothing to do with any of it. But Dunn did create the “Assistant to the Executive assistant” position. So lets see the math. Quincey had already eliminated the Assistant City Managers position, so that was a savings well before Dunn even became City Manager. But Dunn created an Assistant to the Executive Assistant position (and yes that is a assistant to an assistant). At $70,000 pay, plus benefits. So we will go with the number from FedUp for a total of $100,000. In my math thats a negative spending of $100,000, not the BS of a gain of $200,000 you are lying about. Once again, Dunn has a negative $100,000. Just for his girlfriend.
And please explain to me where an independent panel finds you to be qualified, in anyway meets the merit system for promotion. All the panel did was say yes she is qualified. There are dozens of others that are qualified also, for an assistant to an assistant position. But they were not considered following the merit system for promotion.

When you ambushed my family and friends at one of my campaign events in order to manufacture an incident in 2010, I asked you to leave, when you did not leave and you threatened me personally, while I had my 6 month old son in my arms you crossed a very big line. I have not spoken out about this until now but since this thread has become a top 10 listing, let us vet this for what it is. Your attempt to befoul my name by claiming any association to JP is false. As you recall I supported Ray in 2008 and was able to learn the inside operations of how Ray conducts himself during a campaign. Like having Ray confess his sorrow at being part the Pomerski team and taking a tainted $15,000 campaign contribution directly from him in the last election. That is being tied to the Pomerski machine.
As for your other accusations, I will never apologize for defending my family and friends from the maliciousness of smear based campaigning. Your Attempt to lay in wait across the street from one of my events, with the intent on achieving some confrontation was an ill advised plan. As a decorated veteran of the United States Marine Corps, with over 20 years of service and more combat decorations than you or any of your association will ever see in your lifetime, I have from time to time been known to use certain eloquence when challenged in a fight of flight situation.
