SACRAMENTO — Gov. Jerry Brown and fellow Democrats in the Legislature could deal a mortal blow to the governor’s tax-increase initiative if they follow through on plans to appropriate billions of dollars for a high-speed rail system, a new survey suggests.

Fifty-four percent of likely November voters support Brown’s measure to temporarily raise the sales tax and increase income taxes on high earners, according to today’s Field Poll. Thirty-eight percent oppose it and 8 percent are undecided.

Eminent domain raises legal concern

Legal analysts are giving conflicting views on whether a proposed program in San Bernardino County to help homeowners with negative equity stay in their homes could withstand a legal challenge.

San Francisco-based investment firm Mortgage Resolution Partners has proposed the county use eminent domain to seize control of underwater loans and then modify them for homeowners at affordable rates.

SAN BERNARDINO – Kohl’s must pay the city a portion of what it earns from all shipments through the San Bernardino distribution center, despite the retailer’s argument that the requirement is unconstitutional.

The City Council on Monday denied an appeal from Kohl’s, which did not return calls Tuesday asking whether they would further appeal the decision.

UPLAND — The school district’s Board of Trustees has decided to eliminate home-to-school transportation for students in grades 7-12 to address needed cuts in the 2012-13 fiscal year.

The school board spent several weeks discussing possible reductions to Upland Unified’s transportation program.
