RANCHO CUCAMONGA – G3 Holistic in Upland will be able to remain open.

A West Valley Superior Court judge ruled in favor of the medical marijuana cooperative because the case is under review by the California Supreme Court.

“This is a big win,” G3 President Aaron Sandusky said.

Judge Barry Plotkin issued a tentative ruling in favor of G3 and officially adopted it after hearing arguments from counsel representing the city.

“In the long run, this is a good thing. For the citizens of Upland, it’s painful at the moment, but in the long run, we will have more guidance,” Plotkin said.

On Jan. 6, the city of Upland took the co-op to court on the belief they were open in violation of an injunction granted in August 2010 by the West Valley court in Rancho Cucamonga.

The city’s zoning ordinance prohibits medical marijuana dispensaries.

G3 appealed the injunction to the Fourth District Court of Appeals in Riverside. The Appellate Court in June granted a stay on the injunction allowing G3 to remain open pending the resolution of the appeal.
