California Attorney General Kamala Harris has rejected a Republican request that she opine on whether the state budget signed by Gov. Jerry Brown is constitutional.

Republican lawmakers asked Harris last month to examine whether the budget complies with the constitution’s requirements for education funding.

Susan Duncan Lee, supervising deputy attorney general, wrote in response that Harris’ office could not do so because it will likely have to represent the state should someone sue on those grounds.

Lee suggested in a Tuesday letter that the state budget is destined for a court battle.

“Given the budget challenges facing the state, we believe the education funding measures embodied in the current budget package are highly likely to end up in litigation,” Lee wrote.
