San Bernardino County cannot just sue Colonies Partners LP to recoup a landmark $102 million settlement because of former Board of Supervisors Chairman Bill Postmus’s guilty plea to bribery, the county’s CEO said.

“Our outside counsel does not believe that we or anyone else can proceed against Colonies at this point because Colonies has not been proven to be involved,” Greg Devereaux said in an editorial board meeting with the Sun on Wednesday. “Until Colonies has been proven to have committed an illegal act, you can’t go after Colonies just because Bill Postmus says they have.”

The county awarded Colonies Partners LP $102 million in November 2006 to settle the case. Bolstered by Postmus’ plea, prosecutors now say the settlement was tainted by bribery and blackmail.
