San Bernardino County has moved to dismiss a lawsuit filed by its former chief executive on Friday.
The lawsuit filed last year by Mark Uffer originally alleged four causes of action including breach of contract and whistle blower retaliation against the county as the reasons for his dismissal, without cause, on a 3-2 vote of county supervisors in late 2009.
Uffer, an at-will employee at the time, received a one year severance package and has since attained employment with the Colorado River Medical Center in Needles.
Last year a Superior Court Judge threw out three of four causes of action leaving only the whistle blower retaliation claim.
The county has now filed a motion for summary judgement to have the remainder of the legal action dismissed on the merits.
The motion is now set to be ruled on by Judge Donald Alvarez on September 8.

Whistle blowing matters when you dime off the people doing bad things before you get fired. Now since Mark was an a hole way before his departure, and since we all know he had his finger in as many dirty pies as the 5th floor elite, I’m really intrigued with what Mark’s evidence is. Love to see this go to trial.
