A San Bernardino County Superior Court Judge overruled a demurrer filed by lawyers representing Third District Supervisor Neil Derry on Thursday morning.
Superior Court Judge Michael Dest denied the motion to dismiss all charges against Derry and allowed him two weeks to be booked and released at any sheriff’s facility.
Derry entered a plea of not guilty.
Dest also allowed Derry to remain released on his own recognizance while he fights the charges against him.
The first-term supervisor is expected to proceed to a preliminary hearing, now set for July 21, to challenge evidence to charges stemming from allegations he directed a single $5,000 campaign contribution through a Political Action Committee to his own campaign.
