CHINO – City Attorney Jimmy Gutierrez’s recent arrest will figure into his upcoming performance review and whether he will continue to be employed by the city.

Mayor Dennis Yates said council members will also consider levying punitive measures against Gutierrez.

The review is expected to be completed within two months.

Gutierrez, who has been Chino’s city attorney since 1975, pleaded no contest in May to a misdemeanor count of reckless driving in his case stemming from an arrest in October on suspicion of drunken driving.

The plea in West Covina Superior Court came as part of a plea agreement with prosecutors, who agreed to drop two counts of driving under the influence.

“We certainly take this seriously and, as I stated, we will (be) discussing this during his performance evaluation,” Yates said.

Gutierrez is also Rialto’s city attorney, but city officials there didn’t seem to be too concerned about the matter.
