SAN BERNARDINO – When county supervisors gather Tuesday to decide what to do about the massive government corruption alleged by state and local prosecutors, four of the five board members say they will remain objective despite close personal ties to the scandal’s key figures and events.
Last week’s arrests of former county Supervisor Bill Postmus and former assistant assessor Jim Erwin raised new questions about the county’s $102 million payout to settle a lawsuit with developer Colonies Partners four years ago.
Erwin, who is accused of funneling bribes from Colonies to politicians, was chief of staff and a key political ally of Supervisor Neil Derry. Supervisor Brad Mitzelfelt was Postsmus’ chief of staff in 2006 when prosecutors say Postmus took a $100,000 bribe for his support of the Colonies settlement.
Uncharged in the case but implicated as unnamed co-conspirators were Supervisor Paul Biane, who prosecutors allege accepted a $100,000 bribe for his vote, and Mark Kirk, chief of staff to board chairman Gary Ovitt, who is alleged to have accepted $100,000 to deliver Ovitt’s vote.
All of those accused have denied any wrongdoing and only Postmus and Irwin have been charged.
Only Supervisor Josie Gonzales, who voted against the settlement, can claim to be unconnected to the case.
District Attorney Michael A. Ramos has called for the county to recover the $102 million for taxpayers, citing bribery and other illegal acts that surrounded the settlement. But any decision to file a lawsuit against Colonies Partners must be made by the board of supervisors.
On Friday, Derry, Biane, Mitzelfelt and a spokesman for Ovitt, said they saw no conflicts of interest that would prevent them from voting on issues related to the Colonies settlement.
“I don’t think there’s any problem at all,” Ovitt spokesman Burt Southard said.
An attorney for Colonies co-managing partner Jeff Burum dismissed the criminal case as baseless and called the settlement fair and appropriate.
Ovitt stands by his decision to join a 3-2 majority in favor of ending the county’s four-year legal battle over who should pay for improvements to a flood control channel on land Colonies was developing in Upland. The county had lost two important court decisions and Ovitt feared that not settling could cost the county much more, Southard said.
“Gary cast his vote as one of the three on the best evidence and best information available at the time,” he said.
Two experts agreed that the four board members probably don’t have legal conflicts of interest. Whether ethical conflicts exist is more difficult to ascertain.
The supervisors must ask themselves whether they can use good judgment and remain impartial on matters involving Colonies, said Jeffrey Smith, director of the Banta Center for Business, Ethics and Society at the University of Redlands.
The financial relationships surrounding political action committees with alleged ties to Colonies Partners and the supervisors could raise ethical questions, at least, Smith said.
“Supervisors who organized, participated or received political benefits from such PACs should be very sensitive to the ways in which the appearance of a conflict arises when they are making decisions about the entities that have underwritten these PACs’ activities,” Smith said in an e-mail.
Bob Stern, president of the Center for Governmental Studies, said legal conflicts typically deal with economics and apply to income, investments and real estate. Legal conflicts don’t necessarily apply to campaign and PAC donations or relationships, he said.
Hours after Postmus and Erwin were taken into custody, Gonzales called for Tuesday’s special meeting, citing the “explosive” allegations, so the board could “be apprised of its legal options and give direction expeditiously.”
Biane, who spent nearly $50,000 in campaign funds to hire a white-collar criminal attorney, declined a request for an interview but issued a statement defending his vote and his ability to make decisions related to Colonies.
“It does not create a conflict” Biane’s statement said. “I’ve done absolutely nothing wrong or illegal.”
“My vote in favor of the Colonies settlement was done because I could not justify continuing to pay legal fees and risk additional unfavorable court rulings that could have resulted in a judgment the San Bernardino County Flood Control District could not afford to pay,” Biane continued.
Mitzelfelt said that, though he was Postmus’ chief of staff, he was not aware of any alleged bribes and doesn’t feel he has a conflict on Colonies’ matters.
“I’m not under scrutiny in this case so I’m in a very good position to very objectively and aggressively do my part in finding out what happened,” he said.
Mitzelfelt said wasn’t privy to the closed session discussions on the Colonies settlement and had only a few general discussions with Postmus about it.
“I didn’t have a detailed knowledge of what was before the board,” the first district supervisor said.

the context in which ramos is pursuing these charges against his policial rivals… under the color of law!…How does this come to be?
this meeting will be another ‘testament to the absurd’…the parsing of legal and ethical interprations of the issues, is the way the powers that be are going to bring in the ‘fix’to this mess…lord help us

It is my understanding at one point a member of the BOS asked Hueston about calling in the FBI, Hueston said something to the effect of that might cause more problems yet.
I guess you can take that several ways, however Ramos would not be catching the heat if they had.
And of course one or more members of the BOS and their staff might already be in Federal custody. Guess we will never know.

We need to change the County charter so that the BOS elections are County wide and not based on district alone. In other words I would have the pleasure of voting against every one of them. Ovitt, Biane, Mitzelfelt, Gonzalez, and depending on how the next few months go Derry. Time to completely change it up. The way it is set up now keeps the idiots in office. No one down in the valley that knows what an idiot Mitzelfelt is has the pleasure of voting against him because he lives up there and everyone in the high dessert is denied the pleasure of voting against idiots like Josie because they don’t live down here. Stupid. We are all suffering at the hands of this incompetent and corrupt BOS and we should all have a say in getting rid of them. Just sayin…..
Supervisors in all 58 counties are elected by districts as prescibed by the state constitution.

FBI can take jurisdiction on RICO cases. In addition to RICO one can consider this.
Anti-SLAPP (strategic lawsuit against public participation) laws can be applied in an attempt to curb alleged abuses of the legal system by individuals or corporations who utilize the courts as a weapon to retaliate against whistle blowers, victims, or to silence another’s speech. RICO could be alleged if it can be shown that lawyers and/or their clients conspired and collaborated to concoct fictitious legal complaints solely in retribution and retaliation for themselves having been brought before the courts.
Then the state law needs to be changed. Members of this County are not being properly represented.
San Bernardino is a charter county and they can change the charter by vote of the people to have county wide elections. They should also revisit the salariies for board members and tighten up the term limits to two terms including currently served terms.
I think they should include the other elected offices in the two terms and out provision. Also no sex with emplyees unless married to each other would be a good idea for the DA.
I am no legal expert here, but I can foresee some interesting changes of this case, if the Federal government takes over.
1. Evidence rules, maybe stronger, or weaker.
2. RICO rules could be applied.
3. If any of the defendants (new or old) were to be charged, the court hearing would be held out of the region (more expensive to defend yourself, lodging, possibly new attorneys qualified to practice before a Federal Court ect.).
I have changed my mind on “We the Public” should elevate this whole Colonies case to the Federal level.
My reasoning is simple, after I wrote the three points above, I realized that changing the venue from state to federal level may cost the defendants addition money for legal and out of pocket expenses. Since the defendants would be on the hook for paying these bills, and most attorneys do work for free, they may have to come up with more money for legal bills.
It is not my place to incur additional expenses for anyone charged with a crime.
If the defendants (to include John Doe’s 1 -5) whom has their “Skin In the Case”, make the choice to up this case to the federal level, then I would stand behind them. But it’s their choice, not mine.
I stand behind Mr. Postmus and Mr. Erwin rights to a fair trial, and for a jury of their peers to decide their verdict.
In closing, I ask each of you to review this whole case (Colonies Partners L.P. v San Bernardino County Flood Control District) from the beginning to the end. Study the documents that are available on the internet. It is more important that “We the People” should be armed with information that will inform us of the real issues of the case.

The Supervisors are so entwined in this political fiasco that to say they can be objective, is akin to saying a beetle ineradicably trapped in spiderweb is able to un-spin its spiderweb.
Why knew what? When? Who got what? When? By whom? who knew? How much? Who changed their vote or opinions? Why?
Whether Brown can help sort out this mess is further complicated by two elections, that of Brown and Ramos.
It’s time to play the game of if you are dirty, you pay. I don’t think the county DA or state AG offices are in position to do what is ultimately needed: a good housekeeping seal in county government.
The feds need to come in with RICO. The DA & AG give the appearances of vigilantism. On the one hand Brown is playing politics; that is evident in his open bid to have the DA reelected and himself reelected. Brown Both officials have ulterior motives.

Actually, the Does named in the complaint should very definitely include involved reps for Colonial. The bloody bunch of crooks should be in a cell bunking with someone called Hank, Chuck and Buster.
