Cases involving four criminal defendants which are now entering the evidentiary stage appear to now rest on the sole testimony of one key witness.
Former Assistant Assessor Adam Aleman who has plead “no-contest” to one count of Vandalism, two counts of Destroying or Altering Documents, and one count of Presenting a false claim, is now the “go to” guy for District Attorney Michael Ramos, who is attempting to portray himself as a corruption fighter.
Some glaring issues arise here when taking a look at Aleman’s charges.
After being charged with five felony counts, which included presenting and offering false evidence to a grand jury, Aleman approached the District Attorney and agreed to be a confidential informant who would provide evidence and testimony against others. Several months ago the Superior Court accidentally disclosed Aleman as the confidential informant to the Victorville Daily Press.
In exchange for his cooperation, Aleman was allowed to plead “no contest” to four charges that are classified as “wobblers”.
A “Wobbler” is a crime that can either be a misdemeanor or a felony at the time of sentencing.
So if Aleman gives credible testimony in the cases of the other defendants he will be sentenced to the misdemeanors, if not the felonies come into play.
Aleman also has his original five charges active and subject to dismissal.
Since his cooperation as a witness, Aleman has professed to others how he was pressured by investigators into making statements that were only speculation and not necessarily true. Aleman is known to be a pathological liar and manipulator by many. How he gained this level of importance without reliable corroboration is interesting to say the least.
Some of Aleman’s statements border on the bizarre, and are better suited for a fictional series.
This week we were all treated to conclusion of the Preliminary Hearing for former Assessor employee Rex Gutierrez. Gutierrez is also a Rancho Cucamonga City Councilman.
While on the witness stand District Attorney Investigators when making their case against Gutierrez repeated a plethora of statements given to them by Aleman in order to convince a Superior Court Judge to hold Gutierrez to stand trial. Aleman was not produced as a witness for the hearing.
The standard of evidence needed in order to have a defendant held to stand trial at the Preliminary Hearing stage is a “Scintilla” of evidence. Which for now Aleman’s statements when repeated by investigators under oath will suffice.
From this point forward, what District Attorney investigators told the court must be substantiated by Aleman, and from what I know of the Assessors office operation at the time, he let everyone in his reporting structure come and go as they wanted. Aleman never had any significant supervisory or managerial experience and it showed.
Also, it will be interesting to hear what Jim Erwin and Jim Brulte did with the million dollars they allegedly each received.
Now Aleman is finally front and center in the four prosecutions. An uncomfortable position for him to say the least.
